Aliens temporarily present in the United States as students, trainees, scholars, teachers, researchers, exchange visitors, and cultural exchange visitors are subject to special rules with respect to the taxation of their income.

Many international students and trainees are unfamiliar with U.S. tax law and may inadvertently file an incorrect tax return or fail to file any tax return. This can cause serious problems and may endanger their visa status. Some grantees seek the help of professional tax return preparers, but these services can be quite expensive because very few commercial prepares have expertise in the complex field of nonresident alien scholarship taxation.

All students who are on an F or J visa and were physically here in the tax year MUST file at least one U.S. federal tax document to the IRS.Non-residents in the U.S. under an F-1, F-2, J-1, J-2 immigration status still have to complete the Form 8843 even if they received no income for the tax year.

Few simple tests for NR filers:

Calculates the substantial presence test to determine the foreign nationals U.S. residency status;

Verifies each type of payment for any applicable income tax treaty exemptions;
Checks if the individual is eligible for away-from-home expenses (if he or she has been in the U.S. for less than 12 months);
Completes the correct U.S. income tax form - either Form 1040NR or Form 1040NR-EZ;
Prepares any additional statements or attachments, as applicable - Form 2106, Form 8843, Schedule C, and/or Scholarship/Fellowship Grant Statement.
